The basis on which this platform is made available.

1. Operator

DistressedCargo.org is a website and industry-information platform operated by Pommer & Partners International Trading Limited, registered in Ireland, CRO No. 609274. Full operator details are set out in the Legal Notice.

2. Nature and purpose of the platform

The platform provides structured assessment and case intake for distressed cargo and abandoned container situations, together with editorial industry information. It is not a marketplace, auction site or exchange, and no transaction is concluded through this website.

3. No legal or regulatory advice

Information on DistressedCargo.org is provided for general commercial and industry-information purposes.

Nothing on this website constitutes legal advice, tax advice, regulatory approval, customs advice, insurance advice, a laboratory determination, certification of fitness for use, or confirmation of title or authority to sell.

Legal, regulatory, customs, sanctions, food/feed and environmental requirements vary by jurisdiction and should be verified with appropriately qualified professionals and competent authorities.

4. No independent valuation

Output produced through the platform is a commercial assessment. It is not an independent valuation, survey report, laboratory determination or expert opinion, and it should not be presented as one.

5. Commercial interest of Pommer & Partners

DistressedCargo.org is an industry intelligence and cargo-assessment platform operated by Pommer & Partners International Trading Limited.

Pommer & Partners may have a commercial interest in cargo submitted through the platform and may, depending on the circumstances, act as a prospective principal buyer, remarketing party, recovery coordinator or commercial counterparty.

Information provided through DistressedCargo.org does not constitute an independent valuation, fiduciary service, legal opinion, regulatory approval or binding commercial recommendation unless expressly agreed otherwise in writing.

6. No obligation to make or accept an offer

Submitting a case creates no obligation on either party. No purchase, price, timeline, disposal route or recovery outcome is offered or guaranteed. Any transaction is subject to separate agreement, inspection, documentation and applicable law.

7. Authority to submit information

By submitting a case, you confirm that you are authorised to provide the submitted information and documents for the purpose of evaluating the cargo problem.

8. Authority and title to sell

Submission of a case does not establish ownership, title, lien rights or authority to sell. These matters must be verified before any transaction.

This applies in particular to abandoned or unclaimed cargo, rejected cargo, cargo subject to carrier or warehouse liens, insurer-controlled salvage, receiver abandonment and customs-controlled cargo.

9. Accuracy of submitted information

Assessment depends on the information provided. You are responsible for the accuracy and completeness of what you submit, and for informing us where material facts change or where a document later proves inaccurate.

10. Confidential handling and permitted disclosure

Submitted case information is handled on a need-to-know basis and is not published as part of the public website.

Confidential handling does not create legal professional privilege, litigation privilege or any other professional privilege. Information may be disclosed where reasonably necessary to service providers, professional advisers, potential commercial counterparties or competent authorities, subject to applicable law and the purpose for which the information was submitted.

11. AI-assisted functionality

Artificial intelligence may be used to structure submitted information, identify missing information and generate potential commercial recovery routes.

AI-generated output is informational only and may require human review. It is not a legal determination, regulatory approval, laboratory finding, independent valuation or binding commercial decision.

12. Regulated cargo

No food, feed, chemical, pharmaceutical or otherwise regulated cargo should be assumed suitable for an alternative use solely on the basis of the commercial assessment provided by this platform.

Contaminated or damaged food and feed cargo may not be diverted to an alternative use without appropriate analysis and regulatory assessment in the relevant jurisdictions.

13. Illustrative content

Recovery scenarios and editorial content published on this site are illustrative and educational. They do not represent completed transactions, clients, case results, recovery percentages or volumes.

14. Intellectual property

The design, editorial content, structure and data presentations on this site are protected. Reproduction or redistribution without permission is not permitted.

15. External links

This site links to external websites over whose content we have no control. Responsibility for the content of linked sites rests with their respective operators.

16. Sanctions and compliance

Any potential transaction remains subject to applicable sanctions, export-control, customs, anti-money-laundering, counterparty, title and other compliance checks.

No representation is made that a submitted case has already passed such checks.

17. Availability

The platform is made available on an as-available basis. No guarantee is given of uninterrupted or error-free availability, and access may be suspended for maintenance, security or operational reasons.

18. Liability

The platform is provided for business use. To the extent permitted by law, liability for indirect or consequential loss, loss of profit, loss of business or loss of anticipated savings arising from use of the information on this website is excluded.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence and for fraud or fraudulent misrepresentation.

Liability arising from a specific commercial engagement is governed by the agreement concluded for that engagement rather than by these terms.
