Who Can Sell Unclaimed Cargo?

This is the question most frequently answered wrongly, and the one most likely to cause a problem afterwards. A carrier, terminal or warehouse in physical possession of cargo does not automatically acquire the right to dispose of it. Selling without that right can expose the seller to a claim from whoever turns out to hold title.

What usually has to be established

• Title — who owns the goods, which may not be the named consignee
• Authority to sell — whether it arises from contract, lien, statute or a court or customs procedure
• Carrier lien — whether it exists in the applicable jurisdiction and what it secures
• Contractual rights under the bill of lading or terminal conditions
• Customs status — whether the goods are cleared, in transit, bonded or seized
• Notice requirements — who must be notified, in what form, and how long they have to respond
• Local regulatory requirements for the specific commodity

Why customs status often decides everything

Uncleared goods frequently cannot be sold at all until their customs position is resolved, and in some jurisdictions the customs authority itself controls the disposal process. That can be slower than a commercial sale, but attempting to work around it is not a viable strategy.

A workable approach

In practice, the parties establish authority and identify the recovery route in parallel. Establishing authority takes time and local advice; identifying who would buy the cargo, at what level and on what terms, takes time too. Running them sequentially doubles the storage bill.
